1. Overview

Welcome to Montar Australia.

These Terms of Service (“Terms”) govern your use of montar.com.au (the “Website”) and any purchases made through the Website.

In these Terms, “Montar Australia”, “we”, “us” and “our” refer to the business operating Montar Australia. Our online store is powered by Shopify.

By accessing or using the Website or placing an order with us, you agree to these Terms together with our Privacy Policy, Returns Policy and any other policies referred to on the Website.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified, including rights available under the Australian Consumer Law (“ACL”).

2. Eligibility and accounts

You must provide accurate, current and complete information when placing an order or creating an account.

If you create an account, you are responsible for keeping your account credentials confidential and for activity carried out through your account.

You must notify us promptly if you believe your account has been accessed without authorisation.

We may suspend or restrict access to an account where we reasonably believe this is necessary to protect you, Montar Australia, our systems or other customers from fraud, misuse or unlawful activity.

3. Products

We make reasonable efforts to ensure that product descriptions, photographs, colours, specifications, sizing information and other product information displayed on the Website are accurate.

Colours and appearance may vary slightly depending on your device, display settings, lighting and photography.

Product availability may change without notice.

We may modify or discontinue products or product ranges from time to time.

Nothing in this section limits any rights you may have where a product does not correspond with its description, is faulty or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.

4. Product sizing

Sizing information and size guides provided on the Website are intended to assist you in selecting an appropriate size.

Fit may vary between products, styles, fabrics and individual body shapes.

Where a product is not faulty and the customer has selected an unsuitable size, any return is subject to our Returns Policy.

Your rights under the Australian Consumer Law are not affected.

5. Orders

When you submit an order through the Website, you are making an offer to purchase the products in your order.

After your order is submitted, you will normally receive an order confirmation by email.

We may decline or cancel an order where reasonably necessary, including where:

• a product is unavailable;

• there has been an obvious pricing, product information or inventory error;

• we reasonably suspect fraud or unauthorised payment activity;

• we are unable to verify information required to process the order;

• we are unable to deliver the order to the address provided;

• the order appears to have been placed for unauthorised commercial resale; or

• accepting or fulfilling the order would breach applicable law.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product or order to the original payment method, unless another remedy is agreed with you or required by law.

We will contact you using the details provided with your order where reasonably practicable.

6. Order cancellations

Customers may be provided with a limited period after placing an order during which they can request or process a cancellation.

Once this cancellation period has expired, we may already have begun processing, sourcing or preparing your order and may be unable to accommodate a change-of-mind cancellation.

Any cancellation rights provided by Montar Australia are additional to, and do not limit, rights you may have under the Australian Consumer Law.

7. Product availability and extended-range products

Some products available through Montar Australia are held locally in Australia, while other products may be sourced from our extended Montar range outside Australia after your order is placed.

Products sourced from our extended range may have a longer estimated delivery timeframe. Where applicable, this will be communicated on the Website, during checkout, in your order confirmation or through other relevant delivery information.

Availability information is updated regularly but may occasionally change before an order is processed.

If an ordered product becomes unavailable and we cannot supply it within a reasonable period, we will contact you and provide an appropriate option, which may include a refund for the unavailable product.

8. Prices and payment

Unless otherwise indicated, prices displayed to Australian customers are in Australian dollars (AUD) and include GST where applicable.

Shipping charges and any other applicable charges will be displayed before you complete your purchase.

For customers purchasing from outside Australia, prices, taxes, duties and other charges may vary depending on the destination and the arrangements displayed at checkout.

We accept the payment methods displayed at checkout.

You confirm that you are authorised to use the payment method provided for your order.

Prices, promotions and discounts may change from time to time. Changes will not affect orders already accepted, except where permitted or required by law.

9. Pricing and website errors

We take reasonable care to ensure that pricing, promotions, inventory and product information are accurate.

If we identify an obvious error before an order is fulfilled, we may contact you to explain the error and provide available options.

Where the law requires us to honour a displayed or advertised price, we will comply with those requirements.

Nothing in these Terms permits Montar Australia to engage in misleading or deceptive conduct or otherwise avoid obligations imposed by applicable consumer law.

10. Shipping and delivery

We deliver to the locations made available at checkout.

Shipping methods, charges and estimated delivery timeframes are displayed on the Website or during checkout.

Delivery timeframes are estimates unless we expressly state that a particular delivery date is guaranteed.

Some circumstances outside our reasonable control may affect delivery times, including carrier delays, severe weather, natural disasters, customs processing, industrial action, transport disruptions and other events beyond our reasonable control.

If a delivery is materially delayed, please contact us so we can investigate.

Montar Australia remains responsible for its obligations concerning the supply and delivery of goods under applicable law. Nothing in these Terms transfers to you a risk that cannot lawfully be transferred or removes any rights you may have in relation to lost, damaged or undelivered goods.

11. Longer Delivery products

Products identified as Longer Delivery are sourced from Montar's extended international range and therefore require additional time before they can be dispatched to you.

The estimated timeframe displayed for Longer Delivery products includes the additional sourcing and handling period.

If an order contains both locally available products and Longer Delivery products, we may hold the locally available products so that the complete order can be shipped together.

Unless otherwise stated or agreed, the order will be dispatched once all products are available for fulfilment.

Delivery estimates remain estimates and may be affected by circumstances outside our reasonable control.

12. Returns and change of mind

Our voluntary change-of-mind return arrangements are described in our Returns Policy.

Unless otherwise stated, eligible products may be returned within the return period specified in that policy, subject to the applicable return conditions.

For ordinary change-of-mind, sizing or preference returns, customers are responsible for arranging and paying for return shipping unless we agree otherwise.

Any voluntary return policy offered by Montar Australia operates in addition to your rights under the Australian Consumer Law.

13. Australian Consumer Law and faulty products

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, compensation or another remedy depending on the circumstances and whether the failure is major or minor.

For a major failure, you may be entitled to reject the goods and choose a refund or replacement and may also be entitled to compensation for reasonably foreseeable loss or damage.

For a failure that is not major, we may be entitled to provide an appropriate remedy within a reasonable time.

Nothing in our Returns Policy, these Terms or any other Montar Australia policy limits your rights under the Australian Consumer Law.

If you believe an item is faulty, damaged, incorrectly supplied or otherwise does not meet a consumer guarantee, please contact hello@montar.com.au.

14. Sale and Final Sale products

Products purchased at a sale or discounted price remain protected by the Australian Consumer Law.

We may designate particular products as Final Sale for the purposes of our voluntary change-of-mind return policy. Where a product is Final Sale, this will be clearly identified before purchase.

A Final Sale designation only limits change-of-mind returns. It does not exclude or restrict any rights or remedies you may have under the Australian Consumer Law in relation to faulty, damaged, incorrectly described or otherwise non-compliant products.

15. Gift cards

Gift cards are subject to any additional terms displayed when purchased or issued.

Gift cards cannot ordinarily be exchanged for cash except where required by law.

Nothing in this section limits rights that cannot lawfully be excluded.

16. Intellectual property

The Website and its content, including trademarks, logos, product names, photographs, graphics, text, videos, designs and other materials, are owned by or licensed to Montar Australia, Montar, or their respective licensors.

You may access and use the Website for personal, non-commercial purposes.

Except where permitted by law, you must not reproduce, distribute, modify, publish, commercially exploit or otherwise use Website content without permission from the relevant rights holder.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

17. Reviews, feedback and user content

If you voluntarily submit a product review, photograph, video, testimonial or other content to us, you confirm that you have the right to provide that content and that it does not infringe another person's rights or breach applicable law.

Where you submit content specifically for publication, promotion or use by Montar Australia, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display and use that content for operating and promoting Montar Australia, subject to applicable law.

We may moderate or remove content where we reasonably believe it is unlawful, misleading, abusive, infringing, fraudulent or otherwise inappropriate.

We will not manipulate or selectively present reviews in a way that would be misleading or deceptive.

18. Acceptable use

You must not use the Website:

• for unlawful or fraudulent purposes;

• to interfere with the operation or security of the Website;

• to distribute malicious software;

• to obtain unauthorised access to accounts, systems or information;

• to infringe intellectual property, privacy or other legal rights;

• to impersonate another person or misrepresent your identity;

• to collect personal information about others without lawful authority; or

• to use automated systems in a manner that materially disrupts, damages or places unreasonable load on the Website or circumvents reasonable technical restrictions.

We are not responsible for independent third-party websites or services that are outside our reasonable control.

Nothing in this section excludes any responsibility that Montar Australia has under applicable law.

20. Shopify

Our online store is powered by Shopify.

Purchases made through the Website are transactions between you and Montar Australia, not Shopify.

Shopify provides ecommerce technology and related services that enable us to operate the Website and process transactions.

Your use of certain Shopify functionality may also be subject to Shopify's applicable terms and privacy practices.

21. Privacy

We handle personal information in accordance with our Privacy Policy and applicable privacy laws.

Our Privacy Policy explains the types of information we collect, how we use and disclose that information, and how you can contact us about privacy matters.

22. Website availability

We aim to keep the Website available and operating properly, but we do not guarantee uninterrupted or error-free access.

The Website may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions or circumstances outside our reasonable control.

To the extent permitted by law, we are not responsible for losses caused solely by temporary Website unavailability where we have taken reasonable care and the outage was outside our reasonable control.

23. Limitation of liability

Nothing in these Terms excludes, restricts or modifies:

• the Australian Consumer Law;

• any consumer guarantee, right or remedy that cannot lawfully be excluded or restricted; or

• liability that cannot lawfully be excluded or limited.

Subject to those rights and to the maximum extent permitted by law, Montar Australia is not liable for loss or damage caused by circumstances outside our reasonable control or by your misuse of the Website or products contrary to their intended purpose or instructions.

Where the law permits liability to be limited, any limitation will apply only to the extent that it is fair, reasonable and legally enforceable in the circumstances.

24. Indemnity

To the extent permitted by law, you are responsible for loss suffered by Montar Australia arising directly from your unlawful use of the Website, your material breach of these Terms, or your infringement of another person's rights, to the extent that the loss was reasonably foreseeable and caused by your conduct.

This section does not require you to indemnify Montar Australia for loss caused by our own negligence, breach of these Terms, breach of law or other wrongful conduct.

25. Events outside our reasonable control

We will not be responsible for a delay or failure to perform an obligation to the extent that the delay or failure is caused by an event outside our reasonable control.

This may include natural disasters, severe weather, fire, flood, war, civil disturbance, government action, industrial disputes, widespread telecommunications or technology failures, transport disruption or significant interruption to international supply chains.

We will take reasonable steps to minimise the effects of such an event and resume affected obligations when reasonably possible.

This section does not exclude rights or remedies available to you under applicable law.

26. Suspension and termination

We may suspend or terminate access to the Website or an account where reasonably necessary because of fraud, unlawful conduct, misuse, security concerns or a material breach of these Terms.

Termination or suspension does not affect rights and obligations that arose before termination.

27. Changes to these Terms

We may update these Terms from time to time to reflect changes to our business, Website, services, policies or legal obligations.

The current version will be published on the Website together with the date it was last updated.

Changes will not retrospectively remove rights that have already arisen under an existing purchase or contract.

Where required by law, we will provide appropriate notice of material changes.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue to apply.

29. No waiver

If we do not immediately exercise a right under these Terms, that does not mean we waive that right.

30. Governing law

These Terms are governed by the laws applicable in Western Australia, Australia, and applicable Commonwealth laws of Australia.

Subject to any rights you may have to bring proceedings elsewhere under applicable law, the courts and tribunals of Western Australia and relevant Commonwealth courts may hear disputes relating to these Terms.

Nothing in this section limits any rights relating to jurisdiction that cannot lawfully be excluded.
